End User License Agreement

This End User License Agreement ("Agreement") is a legal contract between you (the user) and RecoveryTools ("Company"), the author and owner of the Software. By downloading, installing or using the Software you acknowledge that you have read, understood and agreed to this Agreement and are bound by its terms. If you do not agree with this Agreement you cannot download or install/use the Software.


License Grant


RecoveryTools gives customers the following licenses to install and use the software with the following conditions:

  • Personal License: The software can be installed and activated on 2 computers only for personal, non-commercial use unless you purchase a Commercial License or Technician License.
  • For personal use only: This software cannot be shared with anyone else, nor can it be made available to anyone else via a network.
  • Multi-User usage: You are not allowed to distribute to multiple users or install on a network unless you have purchased a Multi-User or Enterprise License.

Intellectual Property & Copyright

  • Ownership: The software can be installed and activated on 2 computers only for personal, non-commercial use unless you purchase a Commercial License or Technician License.
  • Protection: You cannot remove, change or hide the copyright notices, digital watermarks or proprietary labels from the Software.

Use Restrictions


You must not undermine the security and integrity of our Software by the following actions:

  • Decomposing, reverse-engineering, or attempting to create the source code of our Software.
  • Modifying, adapting, or creating any derivative work based on our Software.
  • Leasing, lending, selling, or sublicensing our Software to anyone other than yourself.
  • Backing up or copying our Software for any reason, except for one "backup" copy intended for archival purposes.

Evaluation & Distribution (Cover CD)


Use of RecoveryTools software as a free trial, or "Evaluation Copy," can also be transferred, through Cover CD's or other digital media formats, by periodicals and software distributors that are associated with or authorized by RecoveryTools to distribute RecoveryTools software. The software must be distributed in its original, unaltered format


Term and Termination


This License is in effect until cancellation.

  • You may cancel this Agreement at any time by removing the Software from your computer and destroying all copies.
  • RecoveryTools may cancel this License if you fail to follow the terms of this Agreement. If the License has been cancelled, you must stop using the Software and destroy all copies you have.

Disclaimer of Warranties


Note: RecoveryTools provides software on an "as is" basis. Although we work hard to ensure our products meet the highest standards of quality, we do not offer a guarantee that our software will be completely free from errors or that it will meet all your expectations.

RecoveryTools disclaims all other warranties about this Software, including all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The previous statement may not be valid in some jurisdictions where it is not permitted to exclude implied warranties; therefore, you should check your local laws to see if the above applies to you.



Limitation of Liability


The maximum liability of RecoveryTools, and/or its Suppliers, shall not, to the fullest extent permitted by applicable law, be liable for any of the following:

  • Consequential, Incidental, or Indirect Damages.
  • Lost Data or Business Profit.
  • Damages Related to the Use of, or Inability to Use, the Software.

    • In no event shall RecoveryTools' liability to you exceed the total amount you have paid to RecoveryTools for the Software License under this Agreement.


Severability


If a court of competent jurisdiction finds any provision in this Agreement to be void, invalid, or unenforceable, all other provisions in this Agreement will remain in full force and effect.


Entire Agreement


This Agreement is the complete agreement between you and RecoveryTools with respect to the Software and it replaces all previous written or verbal agreements, advertisements and representations.
